Terms of Service & Subscription Agreement

By using FAERSIndex, you acknowledge and agree that this software is an analytics aggregation interface. The data is provided "AS IS". Under no circumstances shall FAERSIndex or its operator be held liable for options trading losses, investment write-downs, clinical diagnostic errors, or any other damages arising from the use or interpretation of data displayed on this dashboard.

1. Agreement to Terms

By registering for an account, purchasing a license key, or searching substances on FAERSIndex, you agree to comply with and be bound by these Terms of Service. If you do not agree to these terms, do not purchase a subscription or use the service.

2. Subscription Billing & Cancellations

FAERSIndex offers tiered recurring subscription plans (Investor Catalyst Plan at $35/mo and Professional Plan at $99/mo) billed securely via our Merchant of Record, Lemon Squeezy.

  1. Auto-Renewal: Subscriptions automatically renew monthly unless cancelled before the renewal date.
  2. Refunds: All sales are final. We do not provide refunds or credits for partial subscription months.
  3. Key Expiration: License keys are linked to active billing cycles. If a renewal charge fails, your license key will be deactivated.

3. No Financial or Investment Advice

FAERSIndex is not a financial advisor, broker, or rating agency. The charts, FDA events, and clinical pipeline statuses displayed are historical records. We do not recommend buying, selling, or shorting biotech equities or option contracts. All trading decisions are made solely at your own risk.

4. No Medical or Clinical Advice

FAERSIndex is not a medical device and does not offer clinical advice. Adverse reaction counts are statistical associations and do not prove direct drug causality. Healthcare professionals must exercise independent clinical judgement, and patients should consult their physicians before altering treatments.

5. Government API Uptime Warranty

FAERSIndex queries public databases hosted by openFDA and ClinicalTrials.gov. We have no control over government servers. We do not warrant that queries will be uninterrupted, error-free, or that data updates will occur in real-time.

6. Limitation of Liability & Damages Cap

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FAERSINDEX OR ITS FOUNDERS BE LIABLE FOR ANY CONSEQUENTIAL, INDIRECT, SPECIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA, OR USE).

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF THIS AGREEMENT SHALL BE STRICTLY LIMITED TO THE TOTAL AMOUNT ACTUALLY PAID BY YOU TO FAERSINDEX FOR SUBSCRIPTION SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

7. Governing Law

These terms shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to conflicts of law principles.
